FIRE HORSE Terms of Business

(including services offered under the trading name “Professional Harmony”)

1. About these Terms

These Terms of Business apply to all services provided by:

Sue Holmes, trading as Fire Horse

and Professional Harmony (a trading name of Fire Horse)

(“we”, “us”, “our”).

“You” means the client or participant purchasing services from us.

By booking, paying for, or receiving any service from us, you agree to these Terms.

2. Services Covered

These Terms apply to:

  • 1:1 healing sessions
  • 1:1 healing retreats
  • Residential feng shui, space clearing and geomancy consultations
  • Business and organisational consultations, 1:1 support sessions and feng shui teaching delivered under the name Professional Harmony.

NB: You are purchasing our time, expertise and professional service, not a guaranteed outcome.

3. Booking & Formation of Contract

A contract is formed when:

  • you request a service, and
  • we accept your booking in writing (including email), and
  • any required payment or deposit has been received.

Details such as dates, location, duration, fees and scope of work will be confirmed in writing (including email).

4. Fees & Payment

  • Fees are confirmed at the time of booking.
  • Payment terms will be agreed in writing and may include:
    • full payment in advance, or
    • a deposit with the balance due before the service begins.
  • All payments must be made in cleared funds by the due date.

Failure to pay may result in suspension or cancellation of services.

5. Deposits, Cancellations & Refunds

(Please read carefully – this section is important)

5.1 Deposits

Deposits secure your booking and reserve time that cannot easily be reallocated.

Unless otherwise stated in writing, the deposit is 35% of the total fee.

Deposits are non-refundable, except where required by law.

5.2 Consumer Right to Cancel (Distance Bookings)

If you are booking as a consumer and the contract is made at a distance (for example, online or by email), you have a 14-day cooling-off period from the date of booking.

If you cancel within this period and no services have begun, you will receive a full refund.

If you request that services begin within the 14-day cooling-off period, you acknowledge that:

  • we may charge for services already provided up to the date of cancellation; and
  • once the service has been fully delivered, your right to cancel and receive a refund ends.

5.3 Services Fully Delivered Within 14 Days

Where a service (including a 1:1 session or a retreat) is fully delivered within the 14-day cooling-off period, and you have requested that the service begin during that period, no refund will be due once the service has been completed.

5.4 Cancellation After the Cooling-Off Period

After the cooling-off period has ended, or where it does not apply:

  • deposits remain non-refundable; and
  • if you cancel after work has begun, you are responsible for payment for:
    • services already provided, and
    • any costs or expenses incurred on your behalf.

For 1:1 retreats, accommodation, venue and facilitation costs are committed in advance and are not refundable once the retreat has begun.

 

5.5 Early Departure From Retreats

If you choose to leave a retreat or in-person programme part-way through, for any reason, no refund or partial refund will be given for any unused portion of the service, including accommodation, meals or sessions.

 

5.6 Removal From a Retreat

We reserve the right to ask a participant to leave a retreat or in-person programme if their behaviour is unsafe, inappropriate or disruptive, or breaches agreed boundaries.

In such circumstances, no refund will be issued, and we are not responsible for any additional costs incurred.

 

5.7 Booking Retreat Dates (Important)

For 1:1 retreats, a deposit secures your intention to book and reserves preparatory time.

You must confirm your retreat dates within 28 days of paying the deposit, unless otherwise agreed in writing.

If retreat dates are not confirmed within this 28-day period, the booking will be deemed lapsed and the deposit will be forfeited.

This is because retreat availability, accommodation planning and preparatory work cannot be held indefinitely.

 

5.8 Discretionary Goodwill

Any goodwill gesture (such as a partial credit or transfer) offered outside of these Terms is entirely at our discretion and does not create an entitlement or precedent.

 

6. Our Responsibilities

We will:

  • provide services with reasonable care and skill
  • act professionally, ethically and in good faith
  • make reasonable efforts to meet agreed dates and times

Dates and timings are estimates unless expressly agreed otherwise.

 

7. Your Responsibilities

You agree to:

  • provide accurate and relevant information
  • disclose any information that may affect your suitability or safety
  • engage responsibly and respectfully with the work
  • ensure access to premises where applicable

We are not responsible for delays or losses caused by your failure to meet these obligations.

 

8. Eligibility & Personal Responsibility

By booking or participating in any Fire Horse service, you confirm that:

  • you are physically, mentally and emotionally able to participate in the service you have booked;
  • you will disclose honestly any relevant medical, psychological or mental health information that may affect your participation or safety;
  • you understand that some services, including healing sessions and retreats, may be intensive or emotionally challenging.

You are responsible for seeking appropriate medical, psychological or professional advice where needed. Fire Horse services are not a substitute for medical or mental health care.

 

 

9. Disclosure & Suitability

You agree to disclose honestly any medical, psychological, mental health or substance-related information that may affect your participation or safety.

Fire Horse reserves the right to refuse, pause or discontinue services where the work is not appropriate or safe.

 

10. Professional & Sexual Boundaries

Boundaries & Safe Container

Fire Horse services are offered within a professional, ethical and trauma-informed container.

No sexual or intimate contact will take place between Sue Holmes and any client or participant during sessions, retreats, or at any time in connection with Fire Horse services.

For the safety and integrity of retreat spaces, participants agree not to engage in new sexual or intimate relationships with other participants during a retreat.

Breach of these boundaries may result in the session or retreat being paused or terminated, without refund.

 

11. Health, Healing & Personal Responsibility

Our services:

  • are not medical, psychological or therapeutic treatment
  • do not involve diagnosis or guarantees
  • are not a substitute for professional healthcare

You remain responsible for your own wellbeing, choices and integration.

12. Confidentiality

Both parties agree to treat personal and sensitive information shared during the work as confidential, unless disclosure is required by law.

13. Intellectual Property

All materials, methods and content remain our intellectual property unless otherwise agreed in writing.

They may not be copied, shared or taught without permission.

14. Limitation of Liability

Your attention is drawn to this clause

Nothing in these Terms limits liability for:

  • death or personal injury caused by negligence
  • fraud or fraudulent misrepresentation

Subject to this:

  • we are not liable for indirect or consequential loss
  • total liability is limited to the amount paid for the service in question

15. Force Majeure

We are not liable for delays or cancellations caused by events beyond our reasonable control, including illness, extreme weather, venue issues, travel disruption or government restrictions.

Where possible, services will be rescheduled. Refunds are not guaranteed.

16. Termination

Either party may terminate by written notice.

We may terminate immediately where:

  • payment is not received
  • there is a serious breach of these Terms
  • safety, integrity or boundaries are compromised

17. General

  • These Terms form the entire agreement.
  • If any part is unenforceable, the remainder remains valid.
  • English law applies, and the courts of England and Wales have jurisdiction.
